Court Dismissed A Divorce Case Filed By A Woman Against His Husband

The Jaafariya Family Circuit at the Court of First Instance dismissed a divorce case filed by a woman against his husband, claiming she was negatively affected by the marital relationship with him. The court also ordered her to pay for the expenses and legal fees. The defense counsel representing the husband, Lawyer Mohammed Khalil Al-Qattan, explained that, under the Ja’afari doctrine, violation of marital duties can occur from both sides. The divorce sought by one of the spouses affected by the marital relationship should be accompanied with proof of harm, as established by law. When the complainant could not provide the proof of harm as defined by the law, the court responded in favor of Lawyer Al-Qattan and dismissed the lawsuit.
