Court Imposed Kd 10,000 Fine On A Doctor In Surgery Case

The Court of Cassation imposed KD 10,000 fine on a doctor for failure to inform a Kuwaiti woman, who suffered from minor paralysis after giving birth at a public hospital, about the repercussions of surgery.

Although the court confirmed that there was no medical error, it stressed the need for doctors to inform patients about the danger or consequences of a surgery before the procedure. If a doctor does not inform the patient, he will be accused of failure in his work.

The woman’s lawyer argued in court that she agreed with the doctor to use anesthesia but the latter did not tell her what would happen after the surgery.
