Court Ordered The Imprisonment Of An Expat Employee In Fraud Case

The Criminal Court of Cassation has nullified the lower court’s verdict that ordered the imprisonment of an expatriate employee for one year with hard labor and deportation after completion of term for allegedly defrauding a client in a real estate property sold outside the country. The Apex Court thereby acquitted the defendant of all charges.

The case file indicates the client of one real estate brokerage company lodged a complaint against the broker accusing him of fraudulent acts, saying he signed a contract with the defendant to purchase a property outside the country but the property was not register with the concerned authorities in that country.

On this basis, the Court of First Instance sentenced the defendant to one year in prison with hard labor and deportation after completing the term, and the Court of Appeals upheld the verdict. Lawyer Nuha Al-Raees representing the defendant urged the Apex Court to declare the previous verdicts as null and void. He argued that his client is a mere employee who could not determine the company’s commitment to obligations; indicating the defendant only signed the contract on behalf of the company.
