Court Rejects Lawsuit

The Family Court dismissed an oath-of-condemnation lawsuit filed by a Kuwaiti man against his estranged wife, citing insufficient evidences that the denial of paternity was issued within the first seven days of the child’s birth, says Al-Seyassah.

According to the wife’s counsel Lawyer Abdulmohsen Al-Qattan, the plaintiff filed the lawsuit seeking divorce with an oath and denied paternity of the baby she delivered.

He explained that the estranged couple married according to Sharia and their marriage was consummated, which was confirmed by their statements at the Public Prosecution. The marriage dated back to over nine months from the date of childbirth. The man did not take any legal procedures to deny paternity of the baby within the said period or even apply for a change in the child’s name through the official channel before filing the lawsuit. He also failed to provide any evidence that he denied the paternity within the stipulated first seven days of the child’s birth.
