Is Diya Blood Money Collection Legal – Call To Issue Ruling
What is the legality of the participation of societies in collection of “diya” (blood money)? The issue of raising funds for resolving disputes based on vengeance has returned to the forefront after field inspections teams found advertisements on streets and social media that call for collection of donations to relieve people, citizens and Gulf nationals who are accused of murder from the retribution, reports Aljarida daily.
According to sources, Ministry of Social Affairs and Labor sent an official letter to the Fatwa and Legislation Department, acknowledging the spread of this phenomenon in recent times and the frequent announcement of it by several people.
The ministry requested Fatwa and Legislation Department to issue a ruling on the matter and determine the legality of charitable societies in carrying out fundraising activities for this purpose.
This is in sync with the keenness of the ministry to carry out its mandate in supervising charitable work and regulating any fundraising processes that are taking place in Kuwait.
The sources said, despite Islam’s recognition of diya, there is no legal text or a decision of the Council of Ministers or a ministerial decision that regulates the matter or authorizes it among all the laws and decisions that regulate fundraising for this matter. They added that the ministry is stuck in the face of this thorny and sensitive issue.
