Law Exposes Many People - Onus On Lawyers

The Anti- Money Laundering Law applies to financial institutions and certain professions like lawyers, paralegals and accountants due to their role in processing transactions for their clients, Attorney Dr Bader Al-Mullah said in a symposium on money laundering crimes between incrimination and prevention held recently at the Kuwait Society of Lawyers (KSL).

Al-Mullah confirmed several people involved in money laundering have been exposed and referred to the relevant authorities. He emphasized the seriousness of the issue concerning the work of a lawyer, indicating the law covers lawyers since they engage in certain activities on behalf of other people and they need to shoulder various responsibilities.

He pointed out that KSL also shoulders such responsibilities as stipulated in the law, especially since a lawyer manages his client’s finances including stocks, bank accounts or properties. He said the necessary measures should be taken by the lawyer such as requiring the client to sign the ‘know your client’ (KYC) form and verify his financial resources although most clients refuse to do so because they are not aware that they are covered by this law.

“Whoever represents a minister, undersecretary or lawmaker should take more precautionary measures even when dealing with ordinary issues,” he stressed. He added the money laundering indicators should be applied on the client because the lawyer will be held accountable if any violation is uncovered. He said the lawyer should follow procedures stipulated in the law such as scrutinizing transactions and determining sources of funds although such steps might affect relations with clients.

Dashti accused: Lawyer Munaif Al-Omar has lodged a “State Security” complaint with the Prosecutor General against former MP Abdulhameed Dashti, accusing him of posting on his Twitter account remarks deemed offensive to the Saudi Crown Prince Mohammad Bin Salman during the latter’s visit to Kuwait. On Sept 30, Dashti had published a map showing Kuwait borders that included symbols deemed offensive to the Kingdom of Saudi Arabia and her symbols represented by Crown Prince, First Deputy Prime Minister and Minister of Defense Prince Mohammad Bin Salman.
