Court Verdicts On Citizenship Forgery Cases Of Fake Documents

A legal study revealed that court verdicts on citizenship forgery cases stipulate confiscation of fake documents even if a case falls through due to statute of limitations according to Article 78 of the Penal Code, reports Al-Jareda daily.

Attorney Husain Al-Abdullah edited the study which states that those who got statute of limitations verdicts will not be able to use them in the Administrative Court because the latter deals only with acquittal decisions; in addition to the fact that the government, represented by the Ministry of Interior, submitted such lawsuits to the Public Prosecution.

The study said the Court of Cassation stressed the need to confiscate fake documents. It added the function of the administrative judge is limited to ensuring that decisions on the cancellation of citizenship are issued by the relevant body, according to the law and there is no abuse of power. The administrative judge must also guarantee that lawsuits are included in acts related to withdrawal of citizenship.

The study is based on the opinions of a number of constitutional experts including Dr Othman Khalil who supervised drafting of the Constitution. He affirmed the judiciary is authorized to scrutinize citizenship cancellation decisions.
