Moh Ordered By Court To Pay Kd48,000 To A Kuwaiti Man For Denying Overseas Treatment
Ministry of Health (MoH) has been ordered by the court to pay KD48,000 to a Kuwaiti man for denying him treatment overseas.
The Administrative Circuit at the First Instance Court found in favor of the plaintiff after his lawyer Abdul Mohsen Al-Qattan argued that his client had been subject to unnecessary pain and suffering, in addition to suffering financial loss as a result of the ministry’s wrong decision.
Lawyer Al-Qattan told the court that following a traffic accident his client had been admitted in Farwaniya Hospital and underwent surgery there in his right leg. As the operation was unsuccessful, he was referred to the Al-Razi Hospital for another surgery and specialized treatment.
After the second surgery also proved unsuccessful, the patient applied for overseas treatment at government expense, as the technology required for his treatment was not available in Kuwait. However, the MoH concluded that the patient’s condition was not serious enough to warrant sending him abroad and accordingly rejected his application.
The patient then filed a case in court against the decision by MoH, but it was rejected by the court. He then spent the next five years undergoing treatment in Kuwait without any progress in his condition. The lawyer pleaded before the court that it consider the hardships his client had undergone all these years due to poor treatment and wrong decisions by MoH, and order the ministry to compensate
